Treasury, IRS and the state association

Show shorter lesson

Identify the job first: federal finances, tax administration, or state securities authority.

A department, its tax bureau, and an association

The Department of the Treasury manages federal finances and public debt. Its broader work also includes financial-system safeguards and enforcement of federal finance and tax laws. It has financial regulatory functions, including national-bank supervision. Do not use the shortcut that Treasury never regulates.

The Internal Revenue Service, or IRS, is a bureau of Treasury. It helps people meet their federal tax responsibilities and administers and enforces internal revenue laws. Congress passes tax laws. An investment-income tax question concerns the tax system even though the income came from securities.

NASAA means North American Securities Administrators Association. It is a voluntary association of state, provincial and territorial securities administrators. In the US, state agencies license firms and agents, investigate violations, take state enforcement action and educate investors. Through NASAA, these administrators share information and take part in multi-state enforcement actions.

Keep the association and its members separate. NASAA coordination does not replace a state agency’s licensing or enforcement authority. SEC and FINRA roles are covered in the prior lesson; Fed policy and SIPC/FDIC protection have their own lessons.

Useful distinctionBroad department, not only a tax officeAdministers laws passed by CongressAssociation of administratorsMember agency with state authority
Sharing a financial purpose does not give these bodies the same job. Treasury manages federal finances and debt. Its IRS bureau administers federal tax law. NASAA supports cooperation among administrators. State agencies exercise state securities licensing and enforcement authority.

Try it: Before reading on, match these four tasks on paper: public-debt management; applying federal tax law; coordinating a multi-state enforcement action; state agent licensing. Then compare your answers with the table.

The ruleTreasury manages federal finances and public debt. The IRS is a Treasury bureau that administers and enforces federal tax law; Congress passes tax laws. NASAA is a voluntary association of securities administrators. Its state members license firms and agents and enforce state securities laws; through the association they share information and take part in multi-state enforcement actions.

The closest contrast

NASAA supports its member administrators.

A state agency exercises its state authority.

Cooperation helps members act; it does not replace their licensing or enforcement powers.

Worked example

A firm needs to understand federal tax on securities income and the state license for an agent. Its state regulator also attends a NASAA information-sharing meeting.

  1. The federal tax question points to IRS administration of federal tax law.
  2. The state agent license points to the state securities administrator.
  3. The meeting describes NASAA supporting member cooperation. It does not move the state’s licensing power to NASAA.
  4. Treasury is the broader department that includes IRS and manages federal finances and public debt.
